Cases & Commentaries

Here you will find analysis and discussion of key decisions, focusing on significant Washington State, 9th Circuit, SCOTUS, and other major national and international decisions.

Our common law tradition is largely based on case decisions and precedent to answer legal questions and interpretation. There is rarely a clear-cut and easy resolution to any cases, let alone those cases and controversies that work their way through the judicial system to being heard in a state or the U.S. Supreme Court.

There are generally legitimate areas of difference and dispute in the decisions – resulting in powerful opinions and dissents. The analysis and understanding of both sides of the argument in rendering a well-reasoned decision is the primary job of our appellate judges. Those majority opinions and the minority dissents are the foundation upon which our law is interpreted and administered.
